Abstract
У статті здійснено аналіз вимог кримінального процесуального законодавства, практики Європейського суду з прав людини та вітчизняних судів щодо визначення та обґрунтування наявності підстав застосування запобіжного заходу. Визначено, що кримінальна процесуальна форма прийняття рішення про застосування запобіжного заходу є уніфікованою для всіх видів запобіжних заходів та передбачає встановлення обставин, які свідчать про наявність підстав для його застосування. Акцентується увага на характеристиці двоєдиної підстави застосування запобіжного заходу, а саме: 1) наявність обґрунтованої підозри у вчиненні особою кримінального правопорушення; 2) наявність ризиків. The article analyzes the requirements of criminal procedure law, the practice of the European Court of Human Rights and national courts to determine and justify the existence of grounds for the application of a preventive measure. It is determined that the criminal procedural form of decision-making on the application of a preventive measure is unified for all types of preventive measures and provides for the establishment of circumstances that indicate the existence of grounds for its application. Attention is focused on the characteristic of the double foundation for the application of preventive measure, namely 1) the existence of reasonable suspicion of having committed a criminal offense by a person; 2) the presence of risks.
