| dc.description.abstract | Питання забезпечення прав і свобод громадянина і людини завжди були і є актуальними в демократичній, цивілізованій та правовій державі, зокрема й Україні, яка прагне до цього. Сьогодні, коли реформується національне кримінальне законодавство (за ініціативою Президента України та його указом створена робоча група на чолі з доктором юридичних наук, професором, академіком НАПрН України Ю.В. Бауліним), розглядувані питання потребують особливої уваги щодо вивчення нижчезазначеної криміногенної ситуації, її аналізу та вироблення професійного, комплексного, багаторівневого рішення. У статті проаналізовано геронтологічну злочинність, зокрема вчинення кримінальних правопорушень проти статевої свободи та статевої недоторканості. Цю категорію (особи геронтологічного віку) ще називають особами елегантного, похилого, третього, пенсійного віку. Кожна особа цієї категорії має відносно загальні ознаки, як притаманні віковим змінам, так і особисто індивідуальні (на них впливає спосіб, умови і стиль життя та праці, звички, захворювання, генетична спадковість). Також на цю категорію можуть впливати різні причини, наприклад, певні обставини (самотність, незайнятість, соціальна занедбаність, злиденність, деструктивне віросповідування), традиції (національні, регіональні, сімейні). Issues of ensuring the rights and freedoms of citizens and individuals have always been and are relevant in a democratic, civilized and legal state, including Ukraine, which strives for this. Today, when the national criminal legislation is being reformed (on the initiative of the President of Ukraine and his decree, a working group was established – headed by Doctor of Law, Professor, Academician of the National Academy of Sciences of Ukraine YV Baulin), these issues need special attention to study the following criminogenic situation, its analysis and development of a professional, comprehensive, multilevel solution. The article analyzes gerontological crime, in particular the commission of criminal offenses against sexual freedom and sexual integrity. An attempt is made to determine (find, establish) the lower limit of the gerontological (elderly) age of a person who has committed a criminal offense against sexual freedom and / or sexual integrity, ie the state (physical, psychological, psychiatric, social) associated with age changes (typical, atypical), certain diseases of the body that may motivate a person to commit these criminal offenses, ie may be manifested in a certain part of these persons, criminogenic predisposition. This is important and necessary for research in the criminological dimension. Accordingly, this limit (relative, approximate, indicative), in turn, will provide an opportunity to anticipate their commission, at the general level (national, regional, regional, district, etc.) and individual. | |
