Abstract
У статті аналізуються особливості правової природи окремої думки судді Конституційного Суду України. Констатовано, що окрема думка в кожному конкретному випадку може слугувати формою обґрунтування чи доповнення рішення або ж свідчити про його невмотивованість, що матиме негативний вплив на практику правотворення, отже, і правозастосування. Проаналізовано юридичну силу, причини та практику винесення окремих думок суддями Кон- ституційного Суду України. Судді Конституційного Суду України під час здійснення своїх повноважень є незалежними і підкоряються лише Конституції України та керуються законами України. Суддя, який ухвалив рішення, висновок, ухвалу про відмову у відкритті конституційного провадження у справі або про закриття конституційного провадження, може викласти окрему думку в письмовій формі. The article analyzes the peculiarities of the legal nature of a separate opinion of a judge of the Constitutional Court of Ukraine. It is stated that a separate opinion in each case can serve as a form of justification or addition to the decision or indicate its lack of motivation, which will obviously have a negative impact on the practice of lawmaking, and hence law enforcement. Analyzed the validity, reason and practice making separate opinions by judges of the Constitutional Court of Ukraine. Judges of the Constitutional Court of Ukraine in the exercise of their powers are independent and are subject only to the Constitution of Ukraine and are governed by the laws of Ukraine. A judge who has signed a decision, opinion, decision to refuse to open constitutional proceedings in a case or to close constitutional proceedings may express a separate opinion in writing.
