| dc.description.abstract | Дисертація є комплексним науковим дослідженням сімейно-правового регулювання обов’язку дітей утримувати батьків. Досліджено теоретико-правові, методологічні та правові засади обов’язку дітей утримувати батьків за сімейним законодавством України. У відповідному контексті визначено стан наукової розробки проблеми щодо утримання батьків, наведено методологію проведення дослідження, простежено еволюцію правового регулювання інституту утримання батьків. Визначено поняття обов’язку дітей утримувати батьків, а також встановлено юридичний склад, на підставі якого виникає обов’язок дітей утримувати батьків. Аргументовано, за яких обставин батьки будуть вважатися такими, що потребують матеріальної допомоги. Досліджено підстави добровільного виконання обов’язку дітей утримувати батьків та примусового стягнення аліментів на утримання батьків, додаткових витрат на їх догляд та лікування, а також стягнення за рішенням суду коштів на покриття витрат, пов’язаних з наданням піклування батькам. На підставі наведених положень розроблено низку пропозицій щодо оптимізації сімейного та цивільного процесуального законодавства України щодо правового регулювання обов’язку дітей утримувати батьків. Диссертация является комплексным научным исследованием семейно-правового регулирования обязанности детей содержать родителей. The thesis is a complex research of the issues of procedural of the problem of the responsibility of children to keep their parents under the family law of Ukraine. The theoretical, legal, methodological and legal principles of the obligation of children to support their parents under the family law of Ukraine are investigated. In the relevant context, the state of scientific development of the problem of parental maintenance is determined, the methodology of the research is given, the evolution of legal regulation of the institution of parental maintenance is traced. The concept of the obligation of children to maintenance parents is defined, the legal composition on the basis of which the obligation of children to support parents arises. It is determined under what circumstances parents will be considered in need of financial assistance. The grounds of voluntary fulfilment of the obligation of the child to support the parents and the compulsory collection of alimony for the maintenance of the parents, the additional expenses for their care and treatment, as well as recovering by the court's decision costs for cover the costs of providing parental maintenance. Based on the above provisions, a number of proposals have been developed to optimize the family and civil procedural legislation of Ukraine regarding the legal regulation of the obligation of children to support their parents. | uk_UA |
