Abstract
У статті на підставі нової нормативної бази з’ясовується сутність заволодіння чужим майном шляхом зловживання службовим становищем і визначаються критерії розмежування цього злочину із суміжними складами, зокрема службовими зловживаннями. Робиться висновок щодо необхідності повернення поняття розкрадання у кримінально-правову площину та надання йому нормативного статусу. The article on the basis of the new regulatory framework, clarifies the essence of taking possession of another’s property through abuse of official position and defines the criteria for distinguishing this crime from adjacent structures, in particular, official abuse. the conclusion is made about the need to return the concept of theft to the criminal law plane and to give it a regulatory status.
