Abstract
Висвітлено особливості виконання оперативними підрозділами доручень слідчих щодо розшуку осіб, які ухиляються від слідства за господарські злочини. У процесі виконання доручень слідчого щодо розшуку осіб, які ухиляються від слідства за вчинені господарські злочини, важливе значення мають форми взаємодії слідчого з уповноваженими оперативними підрозділами: а) процесуальні: доручення слідчого щодо проведення негласної слідчої (розшукової) дії (ст. 40, 246 КПК України); надання допомоги слідчому під час провадження негласних слідчих (розшукових) дій (ст. 40 КПК України); б) організаційні: обмін інформацією; координація; консультації. Дорученням слідчого слід вважати письмову вимогу слідчого до керівника оперативного підрозділу, що передбачає спільну й узгоджену співпрацю з розподілом компетенції, функцій, повноважень, взаємних обов’язків, спрямовану на встановлення та затримання осіб, які ухиляються від слідства за господарські злочини. Запропоновано припинити практику формулювання слідчими завдань у дорученнях, які не належать до слідчих (розшукових) і негласних слідчих (розшукових) дій, та внести зміни до ч. 1 ст. 41 КПК України, передбачивши можливість дачі доручень слідчого не лише на проведення слідчих (розшукових) і негласних слідчих (розшукових) дій, а й на проведення інших процесуальних дій у кримінальному провадженні.In this article author revealed features of execution of operational units of orders of investigators about searching persons who evade investigation for economic crimes. In process of execution investigator’s orders about searching persons who evade investigation for committed economic crimes main attention related to form of cooperation between investigator and operational: а) processual: instructions from investigator about carrying out secret investigative (searching) action (Articles 40 and 246 Criminal Procedural Code of Ukraine); help to investigator in process of realization secret investigative (searching) (Article 40 Criminal Procedural Code of Ukraine); б) organizational: exchange of information; cooperation; consultations. Author proposed to consider under investigator’s order written demand from investigator to head of operational unit that includes mutual aids, joint and agreed cooperation with division of competences, functions, powers and responsibilities and directed on identification and arrest of persons, who evade from investigation for economic crimes. Is proposed to stop a practice of forming investigator’s issues, that not attitude to investigative (searching) and secret investigative (searching) action. Also proposed to make changes in part 1 of Article 41 Criminal Procedural Code of Ukraine where anticipate the possibility of giving orders by investigator not only for carrying out investigative (searching) and secret investigative (searching) actions, but also for carrying out another processual actions during criminal proceedings.
