| dc.description.abstract | Статтю присвячено дослідженню питання правового регулювання порядку відсторонення працівника від роботи за появу на роботі в нетверезому стані. За загальним правилом, передбаченим статтею 46 Кодексу законів про працю України, власник або уповноважений ним орган має право відсторонити працівника від виконання роботи в разі: появи на роботі в нетверезому стані. Таке формулювання надає право роботодавцю, а не створює обов’язок відстороняти працівника від роботи за наявності передбачених законодавством підстав. The article is devoted to the study of the legal regulation of the procedure for dismissal of an employee for appearing at work in a state of intoxication. According to the general rule provided by Article 46 of the Labor Code of Ukraine, the owner or his authorized body has the right to suspend the employee from work in the event of: appearing at work in a state of intoxication. Such wording gives the employer the right, and does not create an obligation to dismiss the employee on the grounds provided by law. | |
