| dc.description.abstract | Дисертацію присвячено техніці оприлюднення нормативно-правових актів. Сформульовано низку положень та висновків щодо юридичних прийомів, правил, засобів і способів доведення тексту ухваленого нормативно-правового акта суб’єктом правотворчості шляхом його розміщення в нормативно визначених засобах. Доведено, що техніка оприлюднення нормативно-правових актів спрямована на досягнення ефективності й оперативності оприлюднення, створення автентичної копії оригіналу, гарантованого доступу суб’єктів права до текстів нормативно-правових актів й високий рівень довіри до оприлюднених текстів. Сформовано структурні елементи техніки оприлюднення нормативно-правових актів, описано строки і засоби оприлюднення нормативно-правових актів, мову офіційного оприлюднення нормативно-правових актів, прийоми та правила відображення оригіналів нормативно-правових актів у копіях, інструменти гарантування та забезпечення автентичності текстів копій нормативно-правових актів, правила зберігання оригіналів нормативно-правових актів. Визначено особливості й проблемні аспекти правової регламентації та порядку оприлюднення нормативно-правових актів в Україні. Запропоновано техніко-юридичні правила оприлюднення законів та інших нормативно-правових актів Верховної Ради України, нормативно-правових актів Президента України, нормативно-правових актів Кабінету Міністрів України та центральних органів виконавчої влади, нормативно-правових актів місцевих державних адміністрацій та органів місцевого самоврядування. Обґрунтовано необхідність ухвалення та розроблено проект Закону «Про оприлюднення нормативно-правових актів». Диссертация посвящена технике обнародования нормативно-правовых актов. The dissertation is devoted to the technique of the normative and legal acts promulgation. It has been found out that the studies of the normative and legal acts promulgation in the domestic legal science is characterized by the fragmentation, as the most scientific works are scientific researches in the spheres of 1) legal technique; 2) lawmaking; 3) normative and legal acts promulgation. It has been determined that normative and legal acts promulgation guarantees the quality of the normative and legal act, the presumption of «knowing the law» and the right to information about the new normative and legal acts as well as the functioning of the legal certainty principle. It has been found out that the theoretical and methodological basics of the normative and legal act and the system of the normative and legal acts, which are the ground for forming the technical and legal rules of the normative and legal acts promulgation, make the concept of the normative and legal act, its content and legal document features, the system of normative and legal acts. It has been ascertained that the normative and legal acts promulgation is the final stage of lawmaking after which the goal of lawmaking is achieved – the new law norm is introduced into the law system. It cannot change either the legal force of the adopted normative and legal act, or its content but promulgation is the necessary element of lawmaking. The definition of the normative and legal acts promulgation has been suggested, the content features of the normative and legal acts promulgation, principles and forms of the normative and legal acts promulgation have been determined. The principle of completeness of the text of the normative and legal acts which are promulgated, the principle of authenticity of the text of the normative and legal acts which are promulgated, the principle of publicity of the normative and legal acts promulgation, the principle of formality and reliability of the normative and legal acts promulgation and the principle of officialism of the normative and legal acts promulgation have been substantiated. It has been noted that the most widespread form of the normative and legal acts promulgation is publication. It has been stated that the form of the electronic promulgation of the normative and legal acts can be used independently as the official promulgation as well as along with the official publication as additional (without the official status) when published. The definition of the official promulgation of the normative and legal acts has been given. Its essential features and used forms have been singled out. The official publication as the form of the official promulgation has been distinguished. The definition and essential features of the official promulgation have been suggested. A number of positions and conclusions on legal methods, rules, means and ways of proving the text of the adopted normative and legal act by the subject of lawmaking by placing it in the normatively defined means have been formulated. It has been proved that the technique of the normative and legal acts promulgation is aimed at achieving efficiency and operativeness of the promulgation, creation of the authentic copy of the original, guaranteed access of the law subjects to the texts of the normative and legal acts and the high level of trust to the promulgated texts. The structural elements of the technique of the normative and legal acts promulgation have been formed, the terms and means of the normative and legal acts promulgation, the language of the official promulgation of the normative and legal acts, methods and rules of displaying of the originals of the normative and legal acts in copies, tools of guaranteeing and providing of the authenticity of the texts of the normative and legal acts copies, rules of the storage of the originals of the normative and legal acts. The current state of the law regulation of the normative and legal acts promulgation in Ukraine has been characterized and a set of the normative and legal acts which regulates the promulgation of the normative and legal acts has been formed. The peculiarities and problematic aspects of laws, resolutions and other acts of the Verkhovna Rada of Ukraine, acts of the President of Ukraine and acts of the Cabinet of Ministers of Ukraine, central executive bodies and local state authorities, local self-government bodies promulgation have been determined. The theoretical and legal model of the technique of the normative and legal acts promulgation through the following structural elements: terms of the normative and legal acts promulgation, means of promulgation, the language of the official promulgation, methods and rules of displaying the originals of the normative and legal act in copies, tools of guaranteeing and ensuring the authenticity of the texts of the copies of the normative and legal acts, rules of the storage of the originals of the normative and legal acts have been formed. Technical and legal rules of the promulgation of the laws and other normative and legal acts of the Verkhovna Rada of Ukraine, normative and legal acts of the President of Ukraine, normative and legal acts of the Cabinet of Ministers of Ukraine and the central executive bodies, normative and legal acts of the local state administrations and local self-government bodies have been suggested. The necessity of adoption has been substantiated and the project of the Law “On promulgation of normative and legal acts” has been created. The peculiarities of the normative and legal regulation of the normative and legal acts promulgation, the order of the official promulgation, its forms and means of the official promulgation of the normative and legal acts have been determined in such countries of the Romano-Germanic legal family as the Republic of Poland, the Republic of Belarus, the French Republic, the Federal Republic of Germany, the Duchy of Luxembourg and the Kingdom of Belgium. The peculiarities of the normative and legal regulation of the normative and legal acts promulgation, the order of the official promulgation, its forms and means of the official promulgation of the normative and legal acts have been determined in such countries of the Anglo-American legal family as the United States of America, Great Britain, Canada and Australia. | uk_UA |
