| dc.description.abstract | У статті проводиться теоретико-прикладне дослідження способу вчинення злочину та його співвідношення з наслідком вчинення злочину. Обґрунтовується, що при проведені розслідування слідчий насамперед має справу з наслідками злочину, які відображають спосіб вчиненого діяння. Тобто при ретроспективному аналізі події злочину слідчий, так би мовити, починає з кінця злочину (у часовому розумінні). До того ж, як зазначають науковці, криміналістичне значення способів вчинення (а також приховування) злочину засновано на властивості їх повторювання при скоєнні однорідних діянь однією й тією самою особою (особами) та типових наслідків таких дій. Однак варто враховувати, що аналогія між способами вчинення різних злочинів однією особою не може бути повною. Виділення ознак способу при аналізі однорідних наслідків злочину дозволяє висувати версії про вчинення даних діянь однією особою або про належність злочинця до певної групи осіб. The article conducts a theoretical and applied study of the method of committing a crime and its relationship with the consequences of the crime. It is substantiated that during the investigation, the investigator firstly faces the consequences of the crime, which reflect the manner in which the act was committed. That is, in a retrospective analysis of the crime, the investigator begins at the end of the crime (in the temporal sense). In addition, as scientists note, the forensic significance of the methods of committing (as well as concealing) a crime is based on the properties of their repetition when committing homogeneous acts by the same person (persons) and the typical consequences of such actions. However, it should be borne in mind that the analogy between the ways in which different crimes are committed by one person cannot be complete. The selection of features of the method in the analysis of the homogeneous consequences of the crime allows to put forward versions of the commission of these acts by one person or the belonging of the offender to a certain group of persons. | |
