Abstract
Досліджено питання меж конституційного контролю за процесом виборчої інженерії. Проаналізовано рішення українського та зарубіжних органів конституційної юрисдикції. Сформовано концепцію правової оцінки виборчих систем на предмет відповідності результатів виборів волі народу та забезпечення принципу рівності виборчих прав. Останній розкрито через такі складові частини, як активне виборче право в формальному аспекті, матеріальному аспекті (під час розподілу округів та мандатів), пасивне виборче право, права меншин та гендерних груп. The article focuses on the limits of constitutional control of the electoral process engineering. Analyzed decisions of the Ukrainian and foreign bodies of the constitutional jurisdiction. Formed the concept of legal assessment of electoral systems for compliance with the results of the elections the will of the people and ensure the principle of equality of electoral rights. The principle of equality of electoral rights solved via such components as the active electoral right in the formal aspect, aspect of the material (at the time of distribution of constituencies and seats), passive suffrage, the rights of minorities and gender groups.
