Abstract
Розглядається розвиток ідеї імперії як універсальної світської влади у творах великого поета і мислителя Данте Аліг’єрі (1265–1321). Найдетальніше ця ідея обґрунтована ним у трактаті «Монархія», але присутня і в інших творах Данте – у трактаті «Бенкет», у декількох листах, які стосуються військової кампанії у Італії імператора Священної Римської імперії Генріха VII (1269/1275–1313), який прагнув об’єднати імперію під своєю владою і якого Данте вітав як можливого поновлювача миру в Італії, у славетній поемі «Божественна комедія». Оскільки Данте не розглядає імперію як таку, що скасовує держави в її межах, – навпаки, вважає, що імператор має враховувати відмінність у правопорядках між складовими імперії, – і вбачає призначення імперії в утвердженні й захисті миру, має сенс вважати його політико-правові погляди, висловлені у зв’язку з ідеєю імперії, такими, що мають значення для розвитку міжнародно-правової думки. Investigated is the development of the idea of the Empire as universal secular power in the works of the great Italian poet and thinker Dante Alighieri (1265–1321). The idea is advocated by him most fully in the treatise ‘The Monarchy’, but it is also present in Dante’s other works, namely, in the treatise ‘The Banquet’, in some epistles concerning the military campaign in Italy led by the Holy Roman Emperor Henry VII (1269/1275–1313), who aspired to unite the Empire under his power and whom Dante welcomed as the possible restorer of peace in Italy, in the famous poem ‘The Divine Comedy’. Dante does not see the Empire as cancelling realms within it – on the contrary, he believes that the Emperor has to consider the difference in law and order among the Empire’s parts – and sees the establishment and maintenance of peace as the Empire’s purpose, so it makes sense to estimate his political and legal thoughts, expressed in connection with the idea of the Empire, as those that matter for the development of the international law thought.
