| dc.description.abstract | У статті охарактеризовано зв’язок доступності адміністративного судочинства з іншими важливими фундаментальними вимогами принципу верховенства права, зокрема правом на мирні зібрання, на свободу слова, на знання законів; обґрунтовано його базове місце серед вимог, які становлять мінімальні гарантії захисту прав людини, особливо щодо підо- зрюваних, затриманих, обвинувачених осіб; підкреслено значення презумпції невинуватості, забезпечення незалежності суддів, рівності усіх перед законом. This article provides features and correlations between accessibility of administrative justice with another fundamental principles of the Rule of law, among them are, for example, a right to peaceful assembly, a right to freedom of speech, a right to know the effective laws. Here have been substantiated, that the basic place should be rendered to the minimum guaranties of human rights protection and particularly to the rights of the suspect, accused, arrested persons, author underlined the role of the presumption of innocence, providing independence of justice, equality of everybody before the law. | |
