Abstract
У статті проаналізовані основні положення правового вчення юридичного позитивізму щодо виявлення онтологічних атрибутів права. Розкриті ключові позиції матеріалістичного праворозуміння через поняття держави, закону та їх співвідношення. Автор доводить, що витоком права для позитивістів є воля суверена, за межами якої перебуває лише правове небуття. У статті розкривається позитивістське розуміння права як будь-якої обов’язковості, підкріпленої державним примусом. За основу дослідження взяті праці І. Бентама, Дж. Остіна, Г. Спенсера, Г. Шершеневича. The article analyzes the main provisions of the legal doctrine of legal positivism in identifying the ontological attributes of law. The key positions of materialistic legal thinking are revealed through the concepts of state law and their relation. The author argues that the key source of the law for positivists is the will of the sovereign beyond which there is only legal nothingness. The article reveals a positivist understanding of law as any obligation underpinned by state coercion. The study is based on the works of Bentham, Austin, Spencer, Shershenevich.
