Abstract
У статті проаналізовано потреби та найкращі інтереси дитини, що визначають зміст і характер батьківського виховання. Право на належне батьківське виховання як особисте немайнове право будь-якої дитини опосередковує набуття певних благ через задоволення потреб фізичного, морального-духовного, інтелектуального розвитку. Складність визначення змісту належного виховання визначається суб’єктивними факторами та фактичними способами реалізації правомочностей, що становлять зміст зазначеного права, а способи чітко не регламентовані законодавством, зокрема: догляд, турбота про здоров’я, форми та методи виховання, стилі батьківського виховання, духовний і моральний розвиток. The article analyses the needs and best interests of the child which determine the content and the nature of parental nurturing. The right for proper parental nurturing is a non-property right of any child, it mediates the acquisition of benefits through satisfying the needs of his or her physical, moral, spiritual, intellectual development. The difficulty of determining the content of proper nurturing is determined by: subjective factors, the use of the factual techniques of realizing the right that make up the content of individual rights and techniques which are not clearly regulated by law (care, healthcare, nurturing forms and methods, parental nurturing styles, spiritual and moral development and others). It is established that the interests of the child presuppose the existence of social relations concerning certain needs, which requires the satisfaction of the needs in the best way.
