Abstract
Статтю присвячено науковому аналізу основних підходів до визначення поняття «міжнародні соціальні стандарти», досліджено джерела міжнародних соціальних стандартів, зокрема зосереджено увагу на європейських соціальних стандартах, оскільки Україна знаходиться на шляху до євроінтеграції, що зумовлює необхідність адаптації українського соціального законодавства до вимог законодавства Європейського Союзу. Автором зроблено висновок, що основними особливостями міжнародних соціальних стандартів є: договірний характер, оскільки вони встановлюються шляхом підписання договору; узгодженість волі держав-учасниць договору, оскільки ніхто не може бути примушений визнати обов’язковість дотримання стандартів; стосуються усієї сфери соціального забезпечення, а не окремих її елементів; є вихідними вимогами, що не можуть порушуватись чи ігноруватись державою під час формування національного законодавства у сфері соціального забезпечення; мають різну правову природу із суміжною категорією «принципів соціального права». The article is devoted to the scientific analysis of the main approaches to the determination of the definition of international social standards, legal sources of international social standards are examined, in particular the attention is focused on the European social standards, since Ukraine is on the way to the European integration and this causes the necessity to adapt the Ukrainian legislation to requirements of European Union. We distinguish the main features of the international social standards, such as contractual character, because standards are establishing by signing of a contract; coordination of the will of the participants of the contract, since nobody might be forced to incur obligations; it is related to the all sphere of social protection; it is fundamental requirements that can not be infringed or ignored by the legislator during the lawmaking; it has the different legal essence in comparison with the adjacent category “principles of social law”.
