| dc.description.abstract | У статті проаналізовано питання сутності та меж інтерпретаційної діяльності Конституційного Суду України. Автор характеризує зміни поняття інтерпретаційної діяльності Конституційного Суду України у контексті Закону України «Про Конституційний Суд України» 2017 р. Визначено співвідношення понять «інтерпретаційна діяльність Конституційного Суду України» й «офіційне тлумачення Конституції України». Зроблено висновок, що Конституційний Суд України, здійснюючи тлумачення норм, не повинен змінювати основний зміст, яким їх наділив законодавець. The article has analyzed the question of the essence and limits of the interpretation of the Constitutional Court of Ukraine. The author has analyzed the changes in the understanding of the interpretation of the Constitutional Court of Ukraine in the context of the Law of Ukraine “On the Constitutional Court of Ukraine”, 2017. The correlation between the concepts of “interpretative activity of the Constitutional Court of Ukraine” and “official interpretation of the Constitution of Ukraine” has been determined. It has been concluded that the Constitutional Court of Ukraine, when interpreting the norms, should not change the main content that they have been given by the legislator. | |
