| dc.description.abstract | Мета статті полягає в дослідженні адміністративно-правового статусу Експертної служби Міністерства внутрішніх справ України, зокрема виокремлення його характерних ознак і формулювання на їх основі відповідної дефініції, що неможливо без з’ясування структури першого. Автором проведено ґрунтовне дослідження змістової сутності категорії адміністративно-правового статусу, специфіки функціонування Експертної служби Міністерства внутрішніх справ України та безпосередньо структури адміністративно-правового статусу Експертної служби Міністерства внутрішніх справ України, унаслідок чого виокремлено характерні ознаки останнього, а також запропоновано його дефініцію як динамічної системи взаємопов’язаних юридичних явищ, котрі визначають місце Експертної служби Міністерства внутрішніх справ України та характеризують її як учасника адміністративних правовідносин переважно в частині вирішення її функціонально-організаційних питань, що закріплені в низки законодавчих і підзаконних нормативно-правових актах, а їх реалізація забезпечується державою задля виконання загальної мети її діяльності – здійснення досудового розслідування й установлення істини в судових справах. The purpose of the article is to study the administrative and legal status of the Expert Service of the Ministry of Internal Affairs of Ukraine, in particular to identify its characteristics and formulate on their basis the appropriate definition, which is impossible without clarifying the structure of the first. The author carried out a thorough study of the content of the category of administrative and legal status, the specifics of the functioning of the Expert Service of the Ministry of Internal Affairs of Ukraine and the structure of the administrative and legal status of the Expert Service of the Ministry of Internal Affairs of Ukraine, as a result of which the characteristic features of the latter were identified, and its definition as a dynamic system of interrelated legal phenomena was proposed. determine the place of the Expert Service of the Ministry of Internal Affairs of Ukraine and characterizes it as a participant in administrative legal relations, mainly in terms of solving its functional and organizational issues, which are enshrined in a number of legislative and by-laws normative legal acts, and their implementation is ensured by the state to fulfill the general goal of its activities – implementation preliminary investigation and establishing the truth in court cases. It is determined that a separate important aspect of the functioning of the Expert Service of the Ministry of Internal Affairs of Ukraine is the guarantee of its activities by the state by creating optimal logistical and organizational conditions. | |
