ПРАВОВИЙ СТАТУС МЕДИЧНИХ ПРАЦІВНИКІВ: ПРОБЛЕМИ АДМІНІСТРАТИВНО-ПРАВОВОГО РЕГУЛЮВАННЯ

| dc.description.abstract | У статті розглядаються проблеми правового статусу медичних працівників. Зазначено, що одним із важливих суб’єктів правовідносин, що виникають у сфері охорони здоров’я, виступає медичний працівник, праця якого безпосередньо пов’язана з реалізацією гарантованого Конституцією України права на охорону здоров’я, медичну допомогу і медичне страхування. У свою чергу, серед основних факторів, що зумовлюють соціальну стабільність серед населення, є належне регулювання правового статусу медичних працівників. На жаль, доводиться констатувати, що наявне регулювання правового статусу медичних працівників в Україні не відповідає рівню розвитку суспільних відносин у сфері охорони здоров’я, не достатньою мірою враховує конкретні аспекти медичної діяльності, не забезпечує якісний лікувальний процес, не створює режиму для ефективної реалізації медичними працівниками їхніх прав та обов’язків. Усе це пов’язано з відсутністю належного закріплення та гарантій реалізації адміністративно-правового статусу медичних працівників, особливо в частині захисту прав, свобод та інтересів. The article deals with the problems of legal status of medical workers. One of the important subjects of the legal relationship arising in the field of health care is a medical worker whose work is directly related to the realization of the right to health care, medical care and health insurance guaranteed by the Constitution of Ukraine. In turn, among the main factors that determine social stability among the population is the proper regulation of the legal status of health workers. Unfortunately, it is necessary to state that the existing regulation of the legal status of medical workers in Ukraine does not correspond to the level of development of public relations in the sphere of health care, does not sufficiently take into account specific aspects of medical activity, does not provide a quality medical process, does not create a regime for effective implementation of medical workers of their rights and responsibilities. All this is due to the lack of proper consolidation and guarantees of the implementation of the administrative and legal status of medical workers, especially in the field of protection of rights, freedoms and interests. | |
