| dc.description.abstract | Проаналізовано підстави та правові наслідки фіктивності шлюбу за чинним сімейним законодавством України. Установлено, що «відсутність наміру створення сім’ї» як підстава фіктивності шлюбу в поєднанні з легальним визначенням поняття «сім’я» порушують права людини в частині права на створення сім’ї, свободи від втручання в особисте і сімейне життя, права вільного вибору місця проживання та свободи пересування, чим порушують принцип верховенства права. The grounds and legal consequences of sham marriage under the current family legislation of Ukraine are analyzed. It has been established that “absence of intention to create a family” as a grounds for sham marriage in combination with the legal definition of the “family” concept violates human rights in terms of the right to found a family, freedom from interference in personal and family life, the right to free choice of residence and freedom of movement, and ultimately violates the rule of law. | |
