Abstract
Зв’язок кримінального покарання з легітимізованим державою примусом, спрямованим на суттєве обмеження громадянських прав особи, зокрема обмеження свободи та волі, демонструє потребу дотримання всіх без винятку вимог процесуального законодавства учасниками кримінального процесу з метою недопущення свавільного трактування закону, а відтак неправильного його застосування. У цьому контексті видається цілком логічним наділення вищого органу в системі судів загальної юрисдикції функціями, спрямованими на узагальнення судової практики, забезпечення єдності підходу судів загальної юрисдикції в застосуванні норм і положень законів під час розгляду кримінальних справ, особливо за умови наявності неоднозначного трактування чи розуміння норм матеріального та/або процесуального права. The connection between criminal punishment and state-legitimized coercion aimed at significantly restricting a person’s civil rights, including restrictions on liberty and freedom, demonstrates the need for all participants in criminal proceedings to comply with procedural law in order to prevent arbitrary interpretation of the law and its consequent misapplication. In this context, it seems logical to authorize the supreme body in the system of courts of general jurisdiction for functions aimed at generalizing judicial practice, ensuring uniformity of approach of courts of general jurisdiction in the application of norms and provisions of law in criminal cases, especially in case of ambiguous interpretation or understanding of the provisions of substantive and/or procedural law.
