Abstract
В статті здійснено комплексний аналіз моделей адміністративно-правового захисту конкуренції та тенденцій їх застосування в розвинутих державах, визначено роль та генезис адміністративного права у антимонопольній політиці. Доведено, що в сучасному адміністративному праві зарубіжних країн важливим досягненнями є, зокрема, системність регулювання, в тому числі кодифікація і консолідація адміністративних норм, розвинені процедури, розробленість і застосування принципів адміністративного права, при цьому в контексті проблематики балансу економічних інтересів звертає на себе увагу велике значення принципу пропорційності в регулюванні і правозастосуванні. The article provides a comprehensive analysis of models of administrative and legal protection of competition and trends in their application in developed countries, defines the role and genesis of administrative law in antimonopoly policy. It is proved that in the modern administrative law of foreign countries, important achievements are, in particular, the consistency of regulation, including the codification and consolidation of administrative norms, developed procedures, the development and application of the principles of administrative law, while in the context of the problem of the balance of economic interests, the great importance of the principle of proportionality in regulation and law enforcement draws attention.
