Abstract
У статті досліджено теоретичні аспекти легітимності як феномену загальної теорії права. Наголошено, що легітимності властиві три сторони: наявність якісних повноцінних законів; їх повноцінне сприйняття суспільством та відповідність суспільним запитам; їх реальне, результативне застосування в діяльності індивідів, організацій. Визначено, що у новій юридичній літературі немає єдиної думки щодо розуміння легітимності. Зазначено, що в даний час легітимність трактується в наступних аспектах: як метод, правовий принцип, як вимога і навіть правовий режим на рівні із законністю. The article examines the theoretical aspects of legitimacy as a phenomenon of general theory of law. It is noted that three aspects characterize legitimacy: the presence of high-quality full-fledged laws; their full perception by society and compliance with public needs; their real, effective application in the activities of individuals and organizations. It is determined that in the new legal literature there is no consensus on understanding legitimacy. It is noted that currently legitimacy is interpreted in the following aspects: as a method, a legal principle, as a requirement, and even a legal regime on a par with legality.
