| dc.description.abstract | Наукова стаття присвячена дослідженню актуального питання про своєчасність національного судочинства як однієї з головних засад справедливого правосуддя. В роботі обстоюється теза про те, що реалізується в практичній площині у прецедентних рішеннях Європейського суду з прав людини, за якою винесення чесним та неупередженим судом рішення з дотриманням правил про відкритість і публічність розгляду все ж таки не буде вважатися справедливим, якщо при цьому здійснене безпідставне та невиправдане зволікання в процесі розгляду справи. Автор здійснює аналіз правового поняття «розумний строк», яким оперує як міжнародне, так і українське законодавство. This scholarly article is devoted to the study of the urgent issue of the timeliness of national justice as one of the main principles of fair justice. The thesis argues that the case law of the European Court of Human Rights is being implemented in a practical way, according to which a fair and impartial decision rendering the rules of openness and publicity will not be considered fair if it is unjustified and unjustified a delay in the case. The author analyzes the legal concept of “reasonable term”, which is used by both international and Ukrainian legislation. At the same time, fundamental differences between the national and the conventional meaning of the term are established. It has been established that European legal doctrine does not set clear limits to the period of court proceedings that could be recognized as unambiguously reasonable. | |
