Abstract
Стаття присвячена здійсненню систематизації правовідносин щодо дозвільної діяльності у сфері містобудування, формулюванню висновків щодо перспектив застосування такого способу правового регулювання, а також пропозицій щодо вдосконалення чинного адміністративного законодавства. Визначено, що поняття «правовідносини щодо дозвільної діяльності у сфері містобудування» необхідно виділяти у широкому та вузькому сенсах. У широкому сенсі ним охоплюється весь масив правовідносин, які виникають у зв’язку зі здійсненням такої діяльності або мають щодо неї істотне значення: організаційні, власне відносини щодо видачі дозвільних документів, відносини у сфері містобудування. У вузькому сенсі зазначеним поняттям охоплюються відносини щодо вирішення питання про видачу документів дозвільного характеру, які виникають між суб’єктом видачі дозволу та суб’єктом його отримання. Правозастосовне значення наведеної систематизації полягає у тому, що кожна із виділених груп зазначених відносин має свою істотну специфіку, що має враховуватися при подальшому науковому опрацюванні та реформуванні дозвільної діяльності у сфері містобудування. The article is devoted to the systematization of legal relations regarding permitting activities in the field of urban planning, the formulation of conclusions on the prospects for the application of this method of legal regulation, as well as proposals for improving the current administrative legislation. It is determined that the concept of “legal relations for permitting activities in the field of urban planning” should be distinguished in a broad and narrow sense. In a broad sense, it covers the entire array of legal relations that arise in connection with the implementation of such activities or are essential to it: organizational, the actual relationship for the issuance of permits, relations in the field of urban planning. In a narrow sense, this concept covers the relationship to resolve the issue of issuance of permit documents that arise between the subject of the permit and the subject of its receipt. The law-enforcement significance of the above systematization is that each of the selected groups of these relations has its own significant specifics, which should be taken into account in further research and reform of permitting activities in the field of urban planning.
