Abstract
Метою цієї статті є дослідження іноземного досвіду запобігання незаконним порубці, перевезенню, зберіганню, збуту лісу та визначення ефективних заходів запобігання злочинам зазначеної категорії з метою імплементації їх у правову дійсність України. Методологія.Методологічний інструментарій обрано відповідно до поставленої мети, специфіки об’єкта й предмета дослідження. Здійснено опрацювання, аналіз й узагальнення отриманих результатів. Порівняльно-правовий метод застосовано під час аналізу чинного законодавства та міжнародних нормативних актів; статистичний –для опрацювання емпіричних даних і в процесі дослідження статистичного матеріалу з метою напрацювання математичного підґрунтя. Спеціальним методом дослідження, використаним у статті, є метод системного аналізу. Наукова новизнапублікації полягає в тому, що в ній окреслено проблемні питання запобігання незаконним порубці, перевезенню, зберіганню, збуту лісу в Україні й іншихкраїнах. На підставі узагальнення іноземного досвіду запропоновано ефективні заходи запобігання злочинам зазначеної категорії. Висновки. Сучасний стан лісокористування в Україні, що засвідчують динаміка макроекономічних показників й активізація злочинних посягань у формі незаконнихпорубки, перевезення, зберігання, збуту лісу, характеризується технічним відставанням від рівня світових держав.Для пошуку науково обґрунтованих заходів втручання в економіку лісокористування важливо використовувати досвід провідних країн. Це може виявитися корисним для вдосконалення законодавства України шляхом запозичення позитивних заходів, напрацьованих на шляху протидії незаконним порубці, перевезенню, зберіганню, збуту лісу в іноземних державах.У європейських країнах використання інформаційних систем контролю руху та стеження за деревиною є ефективним заходом запобіганнянезаконним порубці, перевезенню, зберіганню та збуту лісу. Thepurposeof this article is to study foreign experience in preventing illegal logging, transportation, storage, sale of forests and identify effective measures to prevent crimes of this category in order to implement them into the legal reality of Ukraine. Methodology.Methodological tools are selected in accordance with the purpose, specifics of the object andsubject of research. In the course of the research the generalization, processing and analysis of the obtained results were carried out. The comparative legal method was used in the analysis of current legislation and international regulations; statistical –for the processing of empirical data and in the process of studying statistical material in order to develop a mathematical basis. A special research method used in the article is the method of systems analysis. Thescientific noveltyof the publication is that it outlines the problematic issues of prevention of illegal logging, transportation, storage, sale of forests in Ukraine and foreign countries. Based on the generalization of foreign experience, effective measures to prevent crimes of this category are proposed. Conclusions.The current state of forest use in Ukraine, as evidenced by the dynamics of macroeconomic indicators and the intensification of criminal encroachments in the form of illegal logging, transportation, storage, sale of forests, is characterized by a technical lag behind the level of world powers. To find scientifically sound measures to intervene in the economy of forest use, it is important to turn to the experience of leading countries. This can be useful for improving the legislation of Ukraine, by borrowing positive measures developed to combat illegal logging, transportation, storage, sale of forests in foreign countries. In European countries, the use of information systems for traffic control and tracking of timber is an effective measure to prevent illegal logging, transportation, storage, sale of forests
