dc.description.abstractУ дисертації визначено рівень осмислення проблематики співвідношення принципів і норм права у правових системах України та Європейського Союзу. Переосмислено методологію дослідження співвідношення принципів і норм права у правових системах сучасності. Охарактеризовано структуру правової системи шляхом використання теоретичної моделі її загальної структури. Доведено, що принципи права є інтегруючим елементом правової системи. З’ясувано місце та роль норм права у структурі правової системи. Обґрунтовано наявність взаємозв’язку та взаємодії принципів і норм права у правовій системі Європейського Союзу та правових системах держав-членів. Розглянуто особливості співвідношення принципів і норм права у правовій системі України. Проаналізувано дискусійні та проблемні аспекти співвідношення принципів і норм права у правовій системі України в умовах євроінтеграції. В диссертации определен уровень исследования проблемы соотношения принципов и норм права в правовых системах Украины и Европейского Союза, выделен ряд перспективных направлений научных поисков, направленных на разработку теоретико-методологической основы взаимодействия принципов и норм права в правовых системах. In the dissertation it is defined the level of scientific researches of the problem of correlation of norms and principles of law in the legal systems of Ukraine and the EU. The methodology of research of correlation of principles and norms of law in legal systems is reconsidered. The structure of the legal system is characterized by using a theoretical model of the general structure of the legal system. The thesis that the principles of law are an integrating element of the legal system is proved. The peculiarities of the rule of law as a normative element of the subsystem of the legal system are considered. The interrelation of principles and norms of law in the legal system of the European Union and the legal systems of its State-members is substantiated. The peculiarities of the principles and norms of law in the legal system of Ukraine are considered. Problematic aspects of the relationship between principles and norms of law in the legal system of Ukraine in the context of its European integration aspirations are clarified.uk_UA
