Abstract
Наукова стаття присвячена дослідженню актуального питання сутності та значення імунітету свідка в цивільному судочинстві. Наголошено, що з урахуванням подальшого реформування всіх інститутів цивільного процесуального законодавства України перед правовою наукою постає завдання необхідності його адаптації до міжнародних і європейських стандартів. У роботі обстоюється теза про те, що проблема сутності та значення імунітету свідка в цивільному судочинстві в сучасній юридичній літературі ще належно не висвітлена. Нині залишаються ще низка питань, що потребують подальшого дослідження і доопрацювання, а саме: наскільки новий підхід, що закріплений у новій редакції Цивільного процесуального кодексу України, до формування переліку осіб, які не можуть бути допитані як свідки, відповідає сучасним тенденціям і викликам під час реформування цивільного судочинства. The scientific article is focused on studying the relevant issue of the essence and value of witness immunity in civil proceedings. It has been emphasized that taking into account the further reform of all institutions of civil procedural legislation of Ukraine, legal science faces the task of its adaptation to international and European standards. The author of the paper argues that the problem of the essence and value of witness immunity in civil proceedings in the modern legal literature has not been properly covered yet. There is still a number of issues that need further research and revision, namely how the new approach, enshrined in the new wording of the Civil Procedural Code of Ukraine in regard to the formation of a list of persons who cannot be questioned as witnesses, meets the current tendencies and challenges while reforming civil justice.
