| dc.description.abstract | У статті проаналізовано правове регулювання процедури врегулювання спору за участю судді, що в теорії отримала назву судової медіації, з’ясовано та досліджено проблемні аспекти діючого нормативного регулювання, запропоновано шляхи їх усунення. Авторами визначені позитивні аспекти процедури судової медіації як для ефективного розвитку судоустрою у нашій державі, так і для гарантування прав кожної особи на швидке, справедливе та неупереджене судочинство, чому сприяє уникнення значного судового формалізму, намагання підвищити довіру до суду, менша тривалість врегулювання конфлікту, власна відповідальність сторін спору. The article analyzes the legal regulation of the dispute resolution procedure with the participation of a judge (the theoretical name is judicial mediation), clarifies and investigates the problematic aspects of the current regulations, suggests ways to eliminate them. The authors identify the positive aspects of the judicial mediation procedure both for the effective development of the judiciary in our country and to guarantee the rights of every person to fast, fair and impartial proceedings. this is facilitated by the avoidance of significant judicial formalism, attempts to increase trust in the court, shorter duration of conflict resolution, and the parties' own responsibility. | |
