Abstract
Стаття присвячена особливостям вирішення судами спорів про визначення місця проживання малолітньої дитини у період дії на території України воєнного стану у зв’язку із повномасштабним вторгненням військ держави-окупанта. У статті наголошено, що в умовах воєнного стану позитивні зобов’язання держави мають виконуватися з відносною прогнозованістю підходів, а суди продовжують здійснювати свої повноваження і функції. The article is devoted to the peculiarities of resolving disputes by the courts about the determination of the place of residence of a minor child during the period of martial law on the territory of Ukraine due to the full-scale invasion of the troops of the state-occupant. It is noted that the positive obligations of the state must be fulfilled with relative predictability of approaches during martial law, and the courts continue to exercise their powers and functions.
