Abstract
Наукова стаття присвячена дослідженню проблематики теорії держави і права, а саме питанням сучасних правових систем, їх загальній характеристиці, а також визначальним особливостям. Висвітлюється актуальність звернення до зазначеної тематики дослідження, вказуються основні українські та зарубіжні науковці, які займалися та/або займаються вивченням цієї проблематики на теоретичному та практичному рівнях. Досліджується поняття «правова система» та наводяться різні визначення цього поняття і підходи до його розуміння. Висвітлюються позиції окремих вітчизняних і зарубіжних учених, а також їхні підходи до розуміння категорії «правова система». Аналізується сучасне розуміння правової системи згідно широкого та вузького підходів. This article is devoted to the study of the theory of state and law, namely the issues of modern legal systems, their general characteristics, as well as defining features. Among other things, the relevance of the appeal to this research topic is highlighted, the main Ukrainian and foreign scientists who have been and/or are studying this issue at the theoretical and practical level are indicated. The concept of “legal system” is studied and various definitions of this concept and approaches to understanding are given. The positions of some domestic and foreign scholars, as well as their approaches to understanding the category of “legal system” are covered. The modern understanding of the legal system according to broad and narrow approaches is analyzed.
