| dc.description.abstract | У статті розглянуто теоретико-правові засади визначення сутності поняття «культурні цінності» для цілей митного законодавства. Встановлено, що усі культурні цінності є культурними благами, проте не всі культурні блага є культурними цінностями. Основною для цілей митного регулювання є ознака «культурної цінності», а не «об’єкта інтелектуальної власності», якщо культурні цінності наділено ознаками об’єкта інтелектуальної власності. The article considers the theoretical and legal basis for defining the essence of the concept of “cultural values” for the purposes of customs legislation. It has been established that all cultural values are cultural goods, but not all cultural goods are cultural values; the main for the purposes of customs regulation is a sign of “cultural value” and not “object of intellectual property”, if cultural values are endowed with signs of intellectual property. | |
