Abstract
Розглянуто питання ефективності реалізації кримінальної відповідальності. Висвітлено вплив соціокультурних чинників на кримінально-правове регулювання суспільних відносин. Проаналізовано зміст понять «позитивна кримінальна відповідальність» і «негативна (ретроспективна) кримінальна відповідальність», які визначають сутність механізму реалізації кримінальної відповідальності.In the articleit is considered a number of topical issues regarding the effectiveness of practical achievement of the goal of the implementation of criminal liability. It is disclosed that the fulfillment of certain conviction of a court of punishment, including material nature, determines the final result of the application of the rule of law and constitutes one of the defining criteria for the effectiveness of the mechanism for the implementation of criminal responsibility. It is determined that the imperfection of the regulatory framework in terms of compensation for material and moral harm caused by a criminal offense leads to problems of effectiveness in the implementation of criminal liability. The drawbacks of the legal framework are that legal norms aimed at reimbursement of material damage do not eliminate the risks of possible nonpayment of payments determined by the court.
