| dc.description.abstract | Монографію присвячено комплексному дослідженню особливостей державного механізму в забезпеченні прав та свобод людини у сфері національної безпеки України. Проаналізовано нормативні засади, тенденції та проблеми правозастосування у досліджуваній сфері. Розкрито формування новітнього доктринального підходу до засад забезпечення прав та свобод людини у сфері національної безпеки України через з’ясування природи, сутності, виявлення специфіки нормативно-правового забезпечення в умовах інтеграції̈ України до європейського правового та економічного простору під кутом усестороннього захисту прав людини. Обґрунтовано і визначено державний механізм забезпечення прав та свобод людини у сфері національної безпеки України. Сформульовано та визначено розуміння прав людини як об’єкта національної безпеки, вплив сучасної теорії прав людини на формування концепції національної безпеки принципи формування державної політики забезпечення прав людини у сфері національної безпеки, тощо. В результаті одержаних результатів, розглянуто і розроблено пропозиції, які полягають в тому, що на основі комплексного опрацювання проблем теоретичного, нормативного і правозастосовного характеру, розроблена новітня правова доктрина реалізації̈ та забезпечення прав людини у сфері національної безпеки України. Монографія може бути корисною викладачам, правознавцям-практикам, усім, хто цікавиться захистом прав людини і можливість їх ефективного захисту на національному та міжнародному рівнях. The monograph is devoted to a comprehensive study of the peculiarities of the state mechanism in ensuring human rights and freedoms in the sphere of national security of Ukraine. The normative principles, trends and problems of law enforcement in the researched area are analyzed. The formation of the newest doctrinal approach to the principles of ensuring human rights and freedoms in the sphere of national security of Ukraine is revealed through the clarification of the nature, essence, and identification of the specifics of regulatory and legal support in the context of the integration of Ukraine into the European legal and economic space from the angle of comprehensive protection of human rights. The state mechanism for ensuring human rights and freedoms in the sphere of national security of Ukraine is substantiated and defined. The understanding of human rights as an object of national security, the influence of the modern theory of human rights on the formation of the concept of national security, the principles of the formation of the state policy of ensuring human rights in the field of national security, etc. are formulated and defined. As a result of the obtained results, proposals were considered and developed, which consist in the fact that based on the comprehensive study of problems of a theoretical, normative and law-enforcement nature, the latest legal doctrine of the implementation and provision of human rights in the sphere of national security of Ukraine has been developed. The monograph can be useful to teachers, legal practitioners, and anyone interested in the protection of human rights and the possibility of their effective protection at the national and international levels. | |
