Abstract
У статті висвітлюються проблеми визначення моменту закінчення злочину, передбаченого ст. 307 Кримінального кодексу України, у кожній з його форм (виробництво, виготовлення, перевезення, пересилання, зберігання, придбання, збут). Запропоновано для визначення моменту закінчення злочину в зазначених формах враховувати досягнення або недосягнення винним елементарної мети, яка полягає в отриманні найближчого результату від вчинення однієї із зазначених дій. The article deals with the problems of determining the moment of the end of the crime envisaged in the Art. 307 of the Criminal Code of Ukraine in each of its forms (production, making, purchasing, storage, transportation, sending, sale). It is proposed to determine the time of the end of the crime in these forms to take into account the achievement or failure to achieve by the guilty person elemental goal, which consists in the desire to get the closest result of one of these actions.
