| dc.description.abstract | Зростаюча поширеність використання доменних імен у сучасному інформаційному світі актуалізує проблему правової охорони цього об’єкта. Правова охорона доменного імені може бути досягнута лише шляхом відповідних законодавчих змін. Такі зміни мають ґрунтуватися на юридичному дослідженні відносин у сфері доменних імен. Зокрема, важливим питанням є визначення групи об’єктів системи права інтелектуальної власності, до якої слід віднести доменне ім’я, а також його відмежування від цих об’єктів. З огляду на це метою статті є виділення загальних ознак доменного імені як такого, що належить до засобів індивідуалізації, а також його особливостей як засобу індивідуалізації інтернет-ресурсів. The increasing popularity of domain names use in the contemporary informational world makes the problem of domain names legal protection of great topicality. In its turn, this protection can be achieved only by passing appropriate legislative changes. These changes must be based on a legal exploration of relations in a domain name sphere. In particular, it is important to find a group of intellectual property system objects to which a domain name can be related and, at the same time, to separate a domain name from the other objects of this group. Therefore, the purpose of the paper is to determine the common features of a domain name as an object of a particular group in the system of intellectual property objects and to find its special features as a means of Internet sources individualization. The article presents an analysis of a domain name as a means of individualization. It is proved that in the system of intellectual property objects, a domain name is related to means of individualization because its main function is to individualize an Internet source. | |
