| dc.description.abstract | Невід’ємним конституційним правом людини і громадянина є право на судовий захист, закріплене в Конституції України. Відповідно до ст. 32 Декларації прав людини і громадянина кожному гарантується судовий захист його прав і свобод. Однак реалізація суб’єктивного права на судовий захист має й інший, негативний аспект, який, як правило, залишається поза увагою дослідників. Йдеться про несумлінне використання процесуальних прав, в т.ч. права на судовий захист. An inalienable constitutional right of a person and a citizen is the right to judicial protection enshrined in the Constitution of Ukraine. According to Art. 32 of the Declaration of the Rights of Man and of the Citizen, everyone is guaranteed judicial protection of his rights and freedoms. However, the exercise of the subjective right to judicial protection has another, negative aspect, which, as a rule, remains out of the attention of researchers. It is a question of dishonest use of procedural rights, including the right to judicial protection. | |
