| dc.description.abstract | У статті окреслено зміст понять «соціальна держава» та «ліберальна держава», вивчено історію розвитку цих концепцій, досліджено функції та основи їх існування. Зроблено спробу визначити головні відмінності між концепціями соціальної та ліберальної держав. Підкреслено, що й соціальна, й ліберальна держава є складовими частинами демократичної правової держави, проте ліберальна держава ґрунтується на особистих і політичних правах (правах першого покоління), а соціальна держава є гарантом соціальних, економічних і культур- них прав (прав другого покоління). Ліберальна держава per se має лише два зобов’язання, а саме гарантування рівності стартових умов (рівність у матеріальному розумінні) і захист громадян від насильства ззовні та зсередини (безпекова функція держави «нічного сторожа»). The article defines the content of the notions of “social state” and “liberal state”, as well as the history of development of these concepts, the functions and foundations of their existence have been researched. The main differences between the concepts of social and liberal state are identified. It is emphasized that both social and liberal states are the concepts of law-governed state, but the liberal one is based on personal and political rights (First Generation Human Rights, basic rights), and the social one is the guarantor of social, economic and cultural rights (Second Generation Human Rights, rights of recipients). The liberal state essentially has only two obligations: guaranteeing a level playing field (equal access and opportunities, substantive equality) and protecting citizens from outside and inside violence (security function of a “night watchman state”). | |
