| dc.description.abstract | У статті проаналізовано специфіку змісту правовідносин у сфері професійного розвитку державних службовців. Досліджено сутність, структуру, особливості виникнення, розвитку, припинення правовідносин у сфері професійного розвитку державних службовців. Зроблено висновок, що до професійного розвитку державних службовців можуть залучатися і треті особи, які займаються наданням відповідного виду послуг щодо навчання, підготовки, підвищення кваліфікації. Процедура працевлаштування певних категорій державних службовців регулюється Конституцією України та нормами спеціальних законів, що зумовлено специфічним статусом відповідних органів державної влади та правовим положенням державних службовців, котрі у них працюють, висуненням додаткових вимог до кандидатів на зайняття посад у таких суб’єктах публічного права. Аналіз норм чинного законодавства України та доктринальних джерел дає підстави визначити права державного службовця у сфері відносин професійного розвитку. Автор також зазначає, що у разі зайняття особою посади державної служби вона зобов’язана володіти певним рівнем знань, які дозволяють забезпечити дотримання нею Конституції та законів України, принципів державної служби та правил етичної поведінки, вимог законодавства у сфері запобігання та протидії корупції тощо. In the article the specifics of the content of legal relations in the field of professional development of civil servants are analyzed. The essence, structure, peculiarity of origin, development, termination are investigated. The peculiarities of their legal relations in the field of professional development of civil servants are clarified. The researcher concluded that the professional development of civil servants may involve third parties who provide the appropriate type of services for education, training, advanced training. The procedure for employment of certain categories of civil servants is regulated by the Constitution of Ukraine and special laws, which is due to the specific status of both relevant public authorities and the legal status of civil servants who work in them, additional requirements for candidates for positions in such public entities. The analysis of the norms of the current legislation of Ukraine and doctrinal sources gives grounds to determine the rights of a civil servant in the field of professional development relations. The author also notes that if a person holds a civil service position, he must have a certain level of knowledge that allows him to comply with the Constitution and laws of Ukraine, the principles of civil service and ethical conduct, the requirements of legislation to prevent and combat corruption and more. | |
