Abstract
Автором досліджується ефективність адміністративно-правової норми та ставиться питання про необхідність врахування плюралістичного підходу до питання встановлення сутності категорії «ефективність у праві». Підкреслено, що нерозривний зв’язок таких якостей адміністративного права, як його ефективність і соціальна цінність, ефективність та істинність його норм має особливе, фундаментальне значення в контексті розуміння суті та змісту категорії «ефективність норм адміністративного права». Автор переконує, що оцінювати ефективність норми адміністративного права необхідно за її придатністю забезпечувати реалізацію прав і свобод людини в публічній сфері. Зауважено, що разом із цим аспектом незаперечне значення мають цільовий, політичний, економічний, психологічний та інші контексти ефективності адміністративно-правової норми. The author examines the effectiveness of administrative law and raises the question of the need to take into account a pluralistic approach to the question of establishing the essence of the category “effectiveness in law”. It was emphasized that the inextricable link between such qualities of administrative law as its effectiveness and social value, effectiveness and truth of its norms has a special, fundamental meaning in the context of understanding the essence and content of the category “effectiveness of administrative law norms”. The author argues that it is first necessary to evaluate the effectiveness of the norm of administrative law in terms of its suitability to ensure the realization of human rights and freedoms in the public sphere. At the same time, it was noted that along with this aspect, the target, political, economic, psychological and other contexts of the effectiveness of the administrative-legal norm are of indisputable importance.
