    ШТРАФНІ БАЛИ: БУТИ ЧИ НЕ БУТИ? Penalty points: to be or not to be?

    У статті піднімаються проблеми доцільності скасування штрафних балів як виду адміністративного стягнення за вчинення нетяжких транспортних правопорушень. Автор відстоює позицію про те, що існування такого виду покарання відповідає вимогам часу, але потребує певного удосконалення. Зокрема, доцільним є ретельне вивчення зарубіжного досвіду з проблем застосування цієї санкції, застосування принципу індивідуалізації покарання залежно від тяжкості вчиненого та застосування цього стягнення як альтернативного за всі нетяжкі транспортні правопорушення, а не лише зафіксовані в автоматичному режимі. The article reviews whether it is useful to cancel penalty points as a type of administrative punishment for committing minor traffic offenses. The author states that the existence of this type of punishment fits the times but requires some improvement. In particular, it would be useful to thoroughly study foreign practices on the imposition of this sanction, the application of the principle of individualization of punishment depending on the severity of the offense and the imposition of this penalty as an alternative means for all minor traffic offenses, rather than for those that have been recorded automatically only.
