Item ОРГАНИ КОНСТИТУЦІЙНОГО КОНТРОЛЮ ПОСТРАДЯНСЬКИХ КРАЇН: СПІЛЬНІ ТА ВІДМІННІ РИСИ. CONSTITUTIONAL CONTROL IN THE POST-SOVIET STATES: GENERAL AND DISTINCTIVE FEATURES(2021) ЗАКОМОРНА, Катерина Олександрівна; ZAKOMORNA, Kateryna; РОГОЗІН, Денис Андрійович; ROHOZIN, DenysУ статті розглянуто низку питань, що стосуються структури, статусу й повноважень органів конституційного контролю в сусідніх з Україною пострадянських країнах. У роботі проаналізовано чисельність їх складу, визначено коло суб’єктів конституційного подання в кожній із досліджуваних країн. На основі проведеного дослідження запропоновані ідеї реформування статусу та повноважень Конституційного Суду України: пропонується запровадити строковість посади судді та наділити КСУ повноваженнями із вирішення спорів стосовно компетенції вищих органів державної влади. This paper discusses a number of issues related to the structure, status and powers of constitutional control bodies in the post-Soviet countries. The differences between these institutions and the body of constitutional control of Ukraine are analyzed. Particular attention is focused on the key features of the constitutional review body in each of the countries. Thus, a key feature of the Constitutional Court of the Russian Federation is its right to abolish normative legal acts not only at the federal level, but also by the subjects of the federation. Studying the provisions of the Constitution of the Republic of Belarus, it should be noted that the Constitutional Court of Belarus is empowered to decide issues on the compliance of acts of the Supreme Economic Court with the provisions of the Constitution. A key feature of the Kazakhstan constitutional review body is the powers it has been given to review only those laws passed by parliament that have not yet been signed by the President. A specific feature of the status of judges of the Constitutional Court of the Republic of Lithuania is the consolidation of sufficiently high qualifications for candidates in the provisions of the Constitution. No judge can hold office for no more than one term, which is 9 years. The system of constitutional control in Georgia cannot boast of a large number of features. So, they include the absence of a separate section in the Constitution that would regulate the procedure for carrying out constitutional proceedings, as in most countries – only a separate article is devoted to this provision. On the basis of the conducted advancement of the proponation of the idea and the provision of the Constitutional Court of Ukraine, more importantly, from the dispute, the competence of the state bodies is based. It is proponated to propose the lineage of the seat of the court.Item ОСОБЛИВОСТІ ПРОЦЕСУ ЄВРОПЕЙСЬКОЇ ІНТЕГРАЦІЇ ЧЕСЬКОЇ РЕСПУБЛІКИ. FEATURES OF THE PROCESS OF EUROPEAN INTEGRATION OF THE CZECH REPUBLIC(2021) РОГОЗІН, Денис Андрійович; ROHOZIN, Denys; КОМАРОВА, Тетяна В'ячеславівна; KOMAROVA, TetianaСтаттю присвячено висвітленню етапів, які пройшла Чеська Республіка на шляху до повноправного членства у Європейському Союзі. Наведено проблемні аспекти, з якими зіткнулася країна, проаналізовано шляхи їх вирішення, досліджено соціологічні рейтинги підтримки європейської інтеграції серед населення Чехії в різні роки. Спрогнозовано проблеми, які можуть постати перед Україною на тому самому шляху з огляду на закріплення у преамбулі Конституції України європейського та євроатлантичного векторів розвитку. This paper is devoted to highlighting the stages through which the Czech Republic went on its way to full membership in the European Union. At the beginning of the work, attention is paid to the works of Ukrainian, Russian and Czech scientists analyzed in this context, on which the work is based. Further, an introduction to the historical discourse of events in the political and social spheres in the Czechoslovak Republic after the Second World War is carried out. Attention is drawn to the process of division of the Czech and Slovak Republics in the first half of the 90s. The article tells about the choice by the Czech Republic of the political and social vector for «returning to Europe». Other problems of the Czech Republic on the path of European integration are analyzed, among which one can note the conflict with the Federal Republic of Germany over the forced eviction of the German population from the country in the post-war period, based on the decrees of the President of the Czech Republic Edward Benesh, as well as the solution of this problem through diplomatic means. Attention is also drawn to another problem, which was expressed in the conflict with the government of the Austrian Republic regarding the construction of the Temelin nuclear power plant in the South Bohemian region, in the immediate vicinity of the Austrian borders. The Melk Protocol was analyzed, on the basis of which this conflict was resolved. The general conclusions on this work are summarized, in which the success of the Czech strategy for European and EuroAtlantic integration is stated. Problems that may arise for Ukraine on the same path are predicted, taking into account the consolidation of the European and Euro-Atlantic vectors of development in the preamble of the Constitution of Ukraine.
