    Some Aspects of Declaring Legal Acts Unconstitutional. Окремі аспекти визнання правових актів неконституційними

    The relevance of the study is conditioned by a number of problems of declaring legal acts unconstituti-onal and the specifics of the consequences of such decisions to guarantee the rights of the individual. This requires a review of approaches to the temporal effect of the relevant decisions of the Constitutio-nal Court, to guarantee the right to review court decisions adopted based on an act that has been decla-red unconstitutional. At the same time, it is necessary to put forward new proposals for legal regulation of the analysed area, optimal for the rule of law and ensuring the right to a fair trial. Актуальність дос-лідження зумовлена наявністю низки проблем щодо визнання правових актів неконституційними, а також специфікою наслідків ухвалення таких рішень для гарантування прав особи. Наведене потребує перегляду підходів до темпоральної дії відповідних рішень Конституційного Суду, а також до гарантування права на перегляд судових рішень, ухвалених на підставі акта, який визнано неконституційним. Водночас необхідним є висунення нових пропозицій щодо правового регулю-вання аналізованої сфери, оптимального для дотримання принципу верховенства права й забез-печення права на справедливий суд.
