    Статтю присвячено питанням відповідальності гаранта перед кредитором (бенефіціаром) за порушення боржником (принципалом) зобов’язання, забезпеченого гарантією. Акцентовано увагу на тому, що попри очевидний незалежний від основного зобов’язання характер, сьогодні застосування гарантії як ефективного й оперативного заходу забезпечення вимог кредитора значно стримується через неврахування в судовій практиці її фундаментальних властивостей. The article is devoted to the issues of liability of the guarantor to the creditor (beneficiary) for breach by the debtor (principal) of the obligation secured by the guarantee. Emphasis is placed on the fact that despite the obvious nature of the underlying obligation, today the use of the guarantee as an effective and efficient measure to ensure the creditor’s claims is significantly constrained due to disregard in judicial practice of its fundamental properties.
