Здійснено філософсько-правове осмислення процесу формування правосвідомості особистості та доведено, що рушійною силою цього процесу є виховний вплив сім’ї, школи, суспільства, а його кінцевою метою – соціалізація молодої людини як особистості до самостійного дорослого життя в умовах зовнішнього оточення, залучення до активного громадського життя. Встановлено, що формування правосвідомої людської особистості, здатної протистояти негативним викликами сучасної складної соціально-політичної та економічної ситуації має стати прерогативою державної політики в галузі навчання виховання та отримання освіти. В работе исследованы философско-правовые основы генезиса общественных отношений в процессе формирования правосознания человеческой личности. Осуществлено философско-правовое осмысление процесса формирования правосознания личности и доказано, что движущей силой этого процесса является воспитательное влияние семьи, школы, общества, а его конечной целью – социализация молодого человека как личности к самостоятельной взрослой жизни в условиях внешнего окружения, привлечение к активной общественной жизни. Установлено, что формирование правовосознательной человеческой личности, способной противостоять негативным вызовам современной сложной социально-политической и экономической ситуации должно стать прерогативой государственной политики в области обучения воспитания и получения образования.In the first thesis chapter of the scientific work the author studies historical sources and defines the theoretical and methodological principles of the study deals with the philosophical and legal and methodological foundations of the research, analyzes the works of the classics of philosophy, psychology and jurisprudence on issues relating to all components of the system of education, education and education, both in their interrelationship and in relation to the specific features of each of them. The historical analysis of the main stages of development of the processes of education, education and acquisition of education as the main factors of the formation of the personality consciousness is carried out. The conclusion is that the process of formation of the person’s legal consciousness as a philosophical and legal category and a psychological phenomenon should be realized in accordance with generally accepted criteria of lawful behavior and legal culture in the relations between the individual and the society. In the second chapter on the basis of the study of the philosophical works of the antique, medieval thinkers and contemporary and specialists in the field of sociology, the author offers his understanding of the essence of the ontological aspects of the process of forming a personality, which although possesses signs of epistemological, in his opinion, is not a simple acquisition and mastering of knowledge, but is determined how the purposeful influence on the individual in order to assimilate him the rules of conduct necessary for integration into society. It is emphasized that the value of the right lies in the fact that legal ideology, as a component of legal consciousness, is an inalienable regulator of the behavior of the individual. Values of education have a significant impact on the formation of the human person, since they regulate interaction in the educational sphere and form the mutual relations between a person and society. It has been established that psychological influence is always present in educational and educational processes. The method of formation of the children and youth organizations under the control of the authorities as a form of state idol and psychological influence on the society as a whole and on each of its members is explored. In the third chapter of the thesis study the philosophical and legal peculiarities of the transformation of the educational process in Ukraine in the Soviet and post-Soviet times, characterized by a different ideology, are revealed. It was established that the priority direction of the reformation of education in an independent state is the development of a national education system taking into account fundamental changes in all spheres of public life. Currently, national educational legislation includes European standards for the formation of a legal personality and contains many positive characteristics, but the domestic education system, as part of the process of formation of a human person, needs further reform. The role of legal education in the formation of a person’s outlook and proved that corruptive manifestations in the system of education have been substantiated, have a negative influence on the process of forming a person’s legal consciousness In the fourth chapter of the scientific work analyzed with legal education as the determining factor in the relationship between the human person and the society, which contains an axiological component, since it is intended to protect the values of being and is based on universally recognized principles of law: the rule of law, justice, freedom, equality, humanity, the rule of law, which determine the formation of a law-conscious person. The role of the family, school, and society in the formation of the personality legal consciousness has been determined, and the philosophical and legal substantiation of the concept of the triadity of these subjects has been made, which should become the basis of the corresponding state program. The peculiarities of the process of formation of legal consciousness in some segments of the population of modern Ukrainian society by the example of the inhabitants of rural areas are analyzed and determined, and it was emphasized on the necessity of taking measures aimed at raising the level of legal consciousness of the rural population. In the fifth chapter of the thesis it is devoted to studying the experience of forming a person’s legal consciousness in the EU countries and the influence of European experience on the Ukrainian practice of forming a person’s legal consciousness, in particular. Аnalyzed European experience in forming the personality of justice in educational institutions of the Ministry of Internal Affairs, which may be useful for Ukraine. The circle of organizational and legal measures for implementation of the concept of the three main subjects of the process of forming the personality of a person in the life of modern domestic society is outlined.
