Abstract
Констатовано, що комунікативно-дискурсивна методологія спрямована на аналіз теоретичного та практичного юридичного нормотворення як універсального способу пізнання юридичної дійсності. Розглянуто особливості правозастосування норм у судовій практиці, що передбачає обґрунтованість й аргументованість звинувачень, а також їх спростування. Доведено, що важливою професійною рисою сучасного юриста є вміння здійснювати семантичний аналіз висловів природної мови.It is proved that communicative-discursive methodology is aimed at the analysis of theoretical and practical juridical regulations formation, as the general means of juridical reality cognition. Juridical norm as one of forms of coordination social relations regulation between people, among public society and the state and international relations is not self-sufficient trick of good or evil intention of form creation subject, but always is grounded on political appropriateness and requires approval (positive or negative) of social environment. In this sense the problems of juridical norm formation require not only declarative-imperative emphasis, but also their logic – discursive analysis. In the sphere of law and our context of philosophy and law methodology of juridical regulations formation of communicativediscursive analyzer, juridical language is of immense significance in preserving integrity of law-making system, which fundaments the state. The effectiveness of its legislative, law enforcement function in relations with public society directly depends on professionally intelligent of the composed juridical norm. In the given context this is projection of desired for its forming subject of the citizens’ behavior that coordinates their needs and interests. It is proved, that one of the major professional characteristics for a modern lawyer is the ability to carry out semantic analysis of natural language expressions.
