Abstract
Розбудова Української держави після проголошення незалежності України, процеси інтеграції до світової спільноти ставлять перед Україною нові виклики, одним з яких можна вважати потребу в оптимізації здійснення державою своїх функцій, зокрема за допомогою державного апарату. Метою цієї статті є спроба розглянути питання щодо подальших шляхів удосконалення інституту державної служби з огляду на низку сутнісних моментів, які нині є не висвітленими, або ж висвітленими частково. Методологічна основадослідження базується на методі порівняльного аналізу, а також історичному та психологічному методах. Новизна досліджуваної теми полягає в сучасному погляді автора на правовідносини, що склалися в межах існування й розвитку інституту державної служби в Україні. У висновках акцентовано, що визначення державної служби як публічної сприятиме істотному підвищенню ефективності боротьби з корупцією, адже обмеження, які сьогодні пов’язують із проходженням державної служби, матимуть особливу вагу й сенс тоді, коли вони стосуватимуться публічних осіб. The development of the Ukrainian state after the proclamation of Ukraine’s independence, the processes of integration into the world community pose new challenges to Ukraine, one of which is the need to optimize the implementation of the state’s functions, which it performs, inter alia, through the state apparatus. The purpose of this article is to try to look at the question of further ways to improve the institution of civil service in terms of a number of essential points that are still not covered, or partially covered. The methodological basis of the study is based on the method of comparative analysis, as well as historical and psychological methods. The scientific novelty of the researched topic lies in the author’s new view on the legal relations that have developed within the framework of the existence and development of the institute of civil service in Ukraine. The conclusions emphasize that the definition of the civil service as a public service will significantly increase the effectiveness of the fight against corruption, as the restrictions associated with the civil service today will be especially important and meaningful when they apply to public persons.
