Abstract
Досліджено кримінально-правову характеристику злочину, передбаченого ст. 315 Кримінального кодексу України. Проаналізовано поняття «схиляння до вживання наркотичних засобів». Окреслено визначальні чинники кваліфікації цього виду злочинів, що відмежовують їх від інших кримінальних правопорушень. Запропоновано способи вдосконалення цієї кримінально-правової норми. Исследована уголовно-правовая характеристика преступления, предусмотренного ст. 315 Уголовного кодекса Украины. Проанализировано понятие «склонение к употреблению наркотических средств». Определены факторы, определяющие квалификацию данного вида преступлений, отграничивающие их от других уголовных правонарушений. Предложен путь совершенствования указанной уголовно-правовой нормы. The article under the headline «Criminal-legal characteristic of inducement to the use of narcotic drugs, psychotropic substances or their analogues» speaks about the study of criminal-legal characteristics of a crime under art. 315 of the Criminal code of Ukraine. At the beginning it deals with the relevance of the chosen topic. It is argued that the spread of drug abuse and drug addiction today is one of the most pressing concerns worldwide. These antisocial phenomena are a real threat to law and security of States, the health of not only individuals but entire Nations. The text provides statistics that the author commented. Then the author goes to the analysis of recent researches and publications devoted to the topic of drug trafficking. In the text the author describes the crime.
