Abstract
У методичних рекомендаціях розглянуто повноваження Національної поліції України у сфері протидії корупції, зокрема, окреслено правовий статус поліцейського, як спеціально уповноваженого суб’єкта протидії корупції та державного службовця, як працівника в Національній поліції України.
Охарактеризовано загальні положення щодо впровадження механізмів заохочення та формування культури повідомлення; визначено організаційні заходи заохочення викривачів в системі МВС, моральне та матеріальне стимулювання викривачів; представлено судову практику; розглянуто порядок виплати винагороди викривачу; здійснено аналіз та самооцінка успішності заохочення та формування культури повідомлення. Проаналізовано міжнародний досвід заохочення викривачів антикорупційного законодавства, шляхи запровадження його в Україні та рішення Європейського суду з прав людини щодо захисту прав викривачів.
Методичні рекомендації розраховано на уповноваженого з антикорупційної діяльності, поліцейських, державних службовців, представників державних установ, викривачів, керівників підприємств, установ, організацій, професорсько-викладацький склад, ад’юнктів (аспірантів), а також магістрів та курсантів (слухачів, студентів) вищих навчальних закладів із специфічними умовами навчання, які здійснюють підготовку поліцейських. The methodological recommendations consider the powers of the National Police of Ukraine in the field of anti-corruption, in particular, outline the legal status of a police officer as a specially authorized subject of anti-corruption and a civil servant as an employee of the National Police of Ukraine.
The general provisions regarding the implementation of mechanisms of encouragement and the formation of a message culture are described; organizational measures to encourage whistleblowers in the Ministry of Internal Affairs system, moral and material stimulation of whistleblowers are defined; court practice is presented; the procedure for paying the reward to the whistleblower was considered; an analysis and self-assessment of the success of the promotion and formation of the message culture was carried out. The international experience of encouraging whistleblowers in anti-corruption legislation, ways of introducing it in Ukraine, and the decision of the European Court of Human Rights regarding the protection of the rights of whistleblowers are analyzed. Methodological recommendations are intended for anti-corruption commissioners, police officers, civil servants, representatives of state institutions, whistleblowers, managers of enterprises, institutions, organizations, professors and teaching staff, adjuncts (postgraduate students), as well as masters and cadets (students, students) of higher educational institutions with specific training conditions that train police officers.
