Abstract
У статті розглядається зміст і склад делікту, передбаченого ст. 5 ЗУ «Про захист від недобросовісної конкуренції»: неправомірне використання товару іншого виробника. Встановлено, що об’єктом неправомірного використання товару іншого виробника є ділова репутація суб’єкта господарювання, недоторканність якої захищається законом. The article deals with the content and components of the delict stipulated by Art. 5 of the Law of Ukraine “On Protection against Unfair Competition”: unauthorized use of other manufacturer’s products. It is established that the object of unauthorized use of other manufacturer’s products is the goodwill of a business entity that is protected by law. A direct subject of the offence is the material objects, the rights to them or to other intangible assets in which the economic activity and a business entity are individualized.
