Abstract
У статті проаналізований один з етапів судового розгляду кримінального провадження – судові дебати. Аналізуючи відповідні норми КПК України та європейських держав, погляди дослідників, автор подає своє бачення питань, що входять до предмета дослідження. Зазначено, що судові дебати – це етап судового розгляду, в якому учасники судового провадження підводять підсумок з’ясування обставин кримінального провадження, дають оцінку дослідженим у судовому засіданні доказів, обґрунтовують свою правову позицію з урахуванням здійснюваних ними кримінально-процесуальних функцій. The article analyzes one of the stages of the trial in criminal proceedings – the closing arguments. Analyzing the relevant norms of the Criminal Procedure Code of Ukraine and European countries, the views of researchers, the author presents his vision of the issues included in the subject of the study. It is noted that the closing arguments is a stage of the trial in which the participants in the court proceedings sum up the investigation of the circumstances of the criminal proceedings, give an assessment of the evidence examined at the court hearing, justify their legal position taking into account the criminal procedural functions performed by them.
